1. INFORMATION ABOUT US
WELCOME TO INSTATICKET SOUTH AFRICA WEBSITE TERMS AND CONDITIONS FOR USE. THESE TERMS AND CONDITIONS APPLY TO THE USE OF THIS WEBSITE AT www.instaticket.co.za/. BY ACCESSING THIS WEBSITE AND/OR PLACING AN ORDER, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS AND WHEN PLACING AN ORDER YOU MUST SELECT THE TICK BOX AGREEING TO THESE TERMS.
USING THIS WEBSITE INDICATES THAT YOU ACCEPT THESE TERMS REGARDLESS OF WHETHER OR NOT YOU CHOOSE TO REGISTER WITH US OR ORDER FROM US. IF YOU DO NOT ACCEPT THESE TERMS, DO NOT USE THIS WEBSITE.
2. YOUR PERSONAL INFORMATION
2.1 You will be able to access most areas of this Website without registering your details with us. The ‘My Account’ area of this Website is only open to you if you register.
3.1 You are deemed to place an order with us by ordering via our online checkout process. As part of our checkout process, you will be given the opportunity to check your order and to correct any errors. We will send you an order acknowledgement, detailing the products you have ordered.
3.2 Our acceptance of an order takes place when we receive payment for the order. When we receive payment for the order the purchase contract will be made, unless we have notified you that we do not accept your order, or you have cancelled your order.
3.3 We may refuse to accept an order:
(a) where TICKETS are not available;
(b) where we cannot obtain authorization for your payment;
(c) if there has been a pricing or product description error; or
(d) if you do not meet any eligibility criteria set out in our terms and conditions.
3.4 If the details in the e-mail confirming your order are not correct, or if you are not satisfied with the details in the e-mail, please contact us here.
3.5 All order confirmation emails will be supplied in English.
3.6 Where we accept your order, we have a legal duty to supply goods that are in conformity with these Terms and Conditions.
4.1 Where necessary, specific seats will be allocated to you. We have the right to change these seats to others of equal value or an upgraded category.
4.2 An order for TICKETS is not complete until accepted by us. We try to ensure all prices are accurate, but errors may occur. If we discover an error in the price of TICKETS you have ordered we will inform you as soon as possible and we may either cancel the order (in which case you will be refunded the ticket price and any booking, transaction or supplementary fees you have paid) or give you the option of confirming your order at the correct price.
Delivery and collection
4.3 INSTATICKET endeavours to despatch TICKETS as soon as possible. Your ordered TICKETS will be shipped by courier or emailed within 7 days of the event unless;
(a) posting is impractical due to timing or circumstances beyond our control (e.g. printing delays) or;
(b) necessary for reasons of identification or;
(c) your TICKETS are lost in the post or;
(d) we are otherwise unable to post TICKETS to you for any reason.
You will be notified by email (using the contact details provided by you) if this becomes necessary.
4.4 TICKETS will be dispatched to you electronically or by post (including tracked, registered, recorded and regular post) or made available for collection at a specified collection point close to the venue.
4.5 For TICKETS delivered by post, if you have provided an email address you will receive an email confirming dispatch of your order. We cannot usually specify the dates on which you will receive TICKETS. If you do not inform us of the non-receipt of TICKETS within a reasonable time (in any event at least 72 hours before the event) we will have no liability to you.
4.6 Always check your TICKETS upon receipt and advise us promptly of any errors. Mistakes when ordering cannot always be corrected and any corrections are discretionary.
Cancellation Rights and Refunds
4.7 All orders are final. You cannot get a refund if you find the TICKETS cheaper elsewhere, you change your mind or can no longer make the event date. Should you not require the TICKETS that you ordered you are welcome to re-sell them. Please make sure you are buying the TICKETS you want, for correct event and date before you place the order.
4.8 TICKETS cannot be transferred, exchanged, or refunded once purchased other than for the reasons set out in these terms and conditions.
4.9 If the event takes place but you do not receive the TICKETS you have purchased for any of following reasons you will be refunded the ticket price and any booking, transaction or supplementary fees you have paid:
(a) INSTATICKET does not receive the TICKETS from the Promoter and cannot arrange for duplicates to be collected at the box office or;
(b) the TICKETS have been sent to an address different to the one you specified, and you tell us within a reasonable period or;
(c) your TICKETS are not dispatched, and no arrangements are made for the TICKETS to be available for collection at the box office.
4.10 No duplicate TICKETS will be issued to replace TICKETS that have been lost, stolen or damaged after they have been delivered to you, and nor will such TICKETS be refunded.
Cancellation, change or postponement of an event
4.11 Decisions to change or cancel events are the responsibility of the Promoter. INSTATICKET cannot guarantee to inform you of any change or cancellation of any event or be held responsible for refunds or for any resulting costs you may incur for travel, accommodation, any other related goods or service or other compensation.
4.12 You should always check that an event is going ahead at the scheduled date, time and venue.
4.13 If a Promoter cancels an event or makes significant changes to the venue, date, show time or headline act and confirms this to us, INSTATICKET will try to inform you. This will via email the email address provided to us at the time of ordering.
4.14 If an event is rescheduled, changed or moved, the Promoter will usually give you the option of either retaining or exchanging your TICKETS for the new date/location or alternatively claiming a refund. If an event is cancelled by the Promoter, you will normally be offered a refund. Please note that the Booking Fee and any Transaction Fees are not refundable in these circumstances.
4.15 If for any reason you are entitled to a refund, in most cases you must return any TICKETS you have and all refunds will incur a 10% charge for third-party handling fees which INSTATICKET does not receive in the first instance when payment is made:
(a) follow the refund instructions otherwise you may not receive a refund. If these require you to return the TICKETS, do so promptly and within the time frame communicated to you.
(b) TICKETS should be returned (with a copy of the email or letter entitling you to a refund, or a covering note containing your order reference number and contact information) to the specified address by registered post (or an equivalent secure postal method). Please note that the return postage cost is non-refundable.
4.16 Any refund will usually be paid, using the same method you used to buy the TICKETS, within 30 days of the original date of the event or the date that we receive your returned TICKETS, whichever is later.

4.18 No refunds will be offered under any circumstances if you fail to comply with the all the terms and conditions applicable to those TICKETS, the venue or the event.
Attending an event
4.19 Events are not the responsibility of INSTATICKET. INSTATICKET does not organize events and has no responsibility whatsoever for any loss or damage of any kind suffered at or in connection with any event (including loss, damage or theft any personal property at an event).
4.20 Admission to an event is at all times subject to any terms, conditions or rules of the Promoter and the venue operator. If you breach those terms, conditions or rules then the Promoter or venue operator may refuse admission or require you or other ticket holders to leave the venue.
4.21 Amongst other things you will need to comply with health and safety rules and any security requirements (including security searches for the safety of those attending the event). The venue or the Promoter will have rights to refuse admission or eject you in certain circumstances and these are likely to include if you are involved with abusive, threatening, drunken or other anti-social behaviours, or carry offensive weapons or illegal or prohibited substances or make unauthorized audio, video or photographic recordings. There will often also be rules restricting or preventing the admission of latecomers.
4.22 INSTATICKET will highlight any terms, conditions or rules relating to the event of which it is aware and which it considers particularly significant, onerous or unusual. This will generally include age restrictions, ticket types etc. Information on where you can find full details of relevant terms, conditions or rules will be available from the Promoter or venue operator via the box office or their website.
4.23 Before you finalize your booking, please read all the information that applies to the event and/or ticket. If you or any member of your party has particular requirements, please raise these when booking and we will endeavour to address your query. There can be no guarantee that requirements can be met if notified at the event.
4.24 When you receive your TICKETS check the details carefully. When attending the event, carry proof of age if appropriate.
4.25 Specific seats may be allocated to you at the time of booking, but the Promoter or venue operator reserves the right to change these seats to others of equal value or to provide an upgrade in the category.
5. PRICE AND DELIVERY COSTS
5.1 INSTATICKET is an online ticket platform connecting buyers with sellers. We do not set the price of TICKETS on our site, the seller sets the price when listing the TICKETS and we charge a small fee, for which we provide our customers with a 100% guarantee. This means we facilitate an SSL secure transaction, validate the TICKETS, and ensure of on-time delivery OR we will refund you 100% of your payment.
5.2 Market pricing applies, and information displayed on this site relating to pricing is subject to change by the seller without notice.
5.3 Occasionally, an error may occur, and goods may be incorrectly priced in which circumstances we will not be obliged to supply the goods at the incorrect price or at all. INSTATICKET (at our discretion) either cancel your order and refund the price you have paid or use reasonable endeavours to contact you and ask you whether you wish to continue with the order at the correct price.
5.4 Unless stated otherwise, all prices include VAT (where applicable), handling fees and delivery costs.
6. AVAILABILITY OF TICKETS
6.1 Information displayed on this site relating to availability is subject to change by us without notice. We cannot guarantee the permanent or continuous availability of all products on this site.
6.2 All orders are always subject to availability.
7.1 We must receive payment in advance before your order can be processed and the TICKETS can be dispatched.
7.2 Payment for TICKETS can be made by one of the following payment methods:
(a) Credit card via secure checkout facility STRIPE.
8.1 To the extent not prohibited by law, we accept no liability for any:
(a) a loss which is not foreseeable (loss is foreseeable if it was an obvious consequence of our breach or if it was contemplated by you and us at the time you and we entered into our contract) or;
(b) a loss which arises when we are not at fault or in breach of these Terms and Conditions or;
(c) business loss (which includes loss of profits, loss of business, contracts, goodwill, business opportunity and other similar losses, as well as business interruption).
(d) any third-party travel costs associated with your booking.
8.2 Nothing in these terms will affect any liability we may have:
(a) for fraudulent misrepresentation or;
(b) for death or personal injury arising from our negligence or;
(c) for breach of any condition as to title or quiet enjoyment of or in relation to any TICKETS supplied by us or;
(d) in relation to any other liability, including any liabilities under the sale of goods or supply of services legislation, that may not by applicable law be excluded or limited.
9. SERVICE ACCESS
9.1 While we endeavour to ensure that this Website is normally available 24 hours a day, we will not be liable if for any reason this Website is unavailable at any time or for any period.
9.2 Access to this Website may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond our control.
10.1 To register with www.instaticket.co.za/ you must be over eighteen years of age.
10.2 Each registration is for a single user only. We do not permit you to share your username and password with any other person nor with multiple users on a network.
10.3 Responsibility for the security of any passwords issued rests with you and if you know or suspect that someone else knows your password, you should contact us immediately.
10.4 We may suspend or cancel your registration immediately at our reasonable discretion or if you breach any of your obligations under these terms and conditions.
11.1 While we endeavour to ensure that the information on this Website is correct, we do not warrant the accuracy and completeness of the material on this Website. We may make changes to the material on this Website, or to the tickets and prices described in it, at any time without notice. The material on this Website may be out of date, and we make no commitment to update such material.
11.2 The material on this Website is provided ‘as is’ without any conditions, warranties or other terms of any kind. Accordingly, to the maximum extent permitted by law, we provide you with this Website on the basis that we exclude all representations, warranties, conditions and other terms (including, without limitation, the conditions implied by law of satisfactory quality, fitness for purpose and the use of reasonable care and skill) which but for these terms and conditions might have effect in relation to this Website.
12. EVENTS BEYOND OUR CONTROL
12.1 We will have no liability to you for any delay in delivering goods you have ordered that is caused by any event or circumstance beyond our reasonable control(including, without limitation, accidents, extreme weather conditions, fire, explosion, flood, storm, earthquake, natural disaster, failure of telecommunications networks, inability to use transport networks, acts of God, terrorist attack, war, civil commotion, riots, strikes, lockouts and other industrial disputes, acts or restraints of Government, and imposition of restrictions on imports or exports).
13.1 If any provision of these Terms and Conditions is found to be invalid, illegal or unenforceable, the validity, legality or enforceability of any other part of these Terms and Conditions and the remainder of the provision in question will not be affected.
13.2 We may update, vary and amend these Terms and Conditions from time to time without prior notice. Each time you order or otherwise purchase any goods from us, the Terms and Conditions in force at that time will apply (as set out on this site).
